December 1, 2017 Amendments to Bankruptcy Rules and Forms

There are several upcoming changes regarding the rules and forms which will impact bankruptcy practice.  The amended rules and forms will be effective December 1, 2017.  The amendments to the Federal Rules of Bankruptcy Procedure include Rules 1001, 1006, 1015, 2002, 3002, 3007, 3012, 3015, 3015.1 (new), 4003, 5009, 7001, and 9009.  The amended forms include Offical Forms 25A, 25B, 25C, 26 (renumbered respectively as 425A, 425B, 425C, and 426), 101, 309F, 309G, 309H, and 309I.

Due to the amendment to Rules 3002(c), the 341a meeting notices for Chapter 13 cases will be docketed by the clerk's office beginning December 1, 2017.

The Court has adopted a local plan form for Chapter 13 cases filed in the Eastern and Western Districts of Arkansas.  The new Official Form 113 will not be used in the Eastern and Western Districts of Arkansas.  The court has also adopted Local Rule 3015-1 - Local Form for Plans filed in Chapter 13 Cases.  Click to view the local plan and the local rule.
